Madras HC pronounces verdict regarding IT notices issued against Chidambaram and family
The Madras high court on Monday quashed a batch of income tax notices issued against former Union finance minister P Chidambaram and his family members reopening assessments for 2010-11.
The relief is second in a row to the family, as the court in November last quashed a similar set of notices issued by the department after reopening assessments of 2009-10.
Justice T S Sivagnanam passed the order after allowing the pleas moved by Chidambaram and members of his family. The judge reiterated that impugned assessment order passed was wholly illegal and the entire proceedings were flawed.
In the light of the fact in respect of the previous assessment years, where the petitioners challenged reopening proceedings with identical facts involved and as this court allowed the said writ petitions, the petitioners had made out a prima facie case for grant of same relief, the judge said.
In 2016, the department reopened a case relating to income generated from a family-held coffee estate in Coorg, Karnataka, and served notices on Chidambaram, his lawyer-wife Nalini, besides his son Karti and his family.
The family challenged the legality of the notices and filed a writ petition in the high court saying it was agricultural income which would be exempted from income tax.
As the court allowed their plea assailing notices pertaining to assessment year 2009-10, the petitioners have moved the present plea on the same grounds.
