Huge setback for Mehbooba Mufti government; Supreme Court Stays FIR against Army Personnel!

In a major setback of the sort for the Mehbooba Mufti-led government in Jammu and Kashmir, Supreme Court has stayed the FIR registered against Army Personnel in connection with the Shopian Shooting. The apex court has also sent notice to Both central and state government to know their stand on this case.This order by Supreme court comes as a result of the plea filed by Army Major Aditya Kumar’s father Lieutenant Colonel Karamveer Singh who challenged the FIR.

Lieutenant Colonel Karamveer Singh who filed plea through Advocate Aishwarya Bhati says that his son was only performing his duty under an extremely hostile atmosphere in the sate.Major Aditya, who is with 10 Garhwal Rifles, was named in the FIR that was filed after three civilians were killed when the army fired at a group of protesters in Shopian on January 27.

Supreme court has asked a reply from the Central and State government within two weeks.He said that the FIR – which booked Major Aditya and the 10 Garhwal Rifles for murder and attempts to murder – will hurt the morale of Army personnel in the discharge of their duty. He is of the opinion that the FIR is an arbitrary use of [Power.

The petitioner also demanded that the rights of the soldiers be protected. And that no soldier should be harassed for performing his duties.He also demanded FIR against those who involve in Terrorist activities which bring great loss to the state.

It was also reported that the Army has filed a Counter-Petition. But later CM Mehbooba Mufti clarified that no such FIR has been lodged in relation with the Shopian firing.
“A day after the police filed an FIR into the firing incident, the Army filed a report about the incident in a police station. That report has been kept on record with the already filed FIR into this incident,” Mufti had told the state assembly.
