Kerala Administrative Tribunal Stays Transfer Proceedings of HSE Teachers

Kerala Government is drawing flak for different reasons and their lax policy regarding the transfer of Higher Secondary Teachers is the latest one to gather attention.

Apparently, a group of teachers have conveniently carved out a niche in schools near to their home and are reluctant to work elsewhere. While the rules demand them to have definite terms of out-station services, it has been sabotaged and over-ridden using priority and compassionate postings to keep themselves working near their home.

Kerala Administrative Tribunal (KAT) has stayed the transfer proceedings till August 31 based on a petition filed by teachers. One can already see where it’s going from there as interested parties can vouch for the ‘difficulty of students’ to have different teachers in the middle of a term to further delay the transfers. The KAT has stayed the proceedings citing that the provisional transfer list published by Department of Higher Secondary Education violated government orders came in 2015 and 2016.

Serious allegations were made for so long that the transfers are based on priority grounds like Compassionate posting, Spouse postings, NRI postings, physically handicapped etc rather than based on seniority. This is the loophole that has been widely exploited by ineligible teachers to keep themselves in the list and to get posted in schools near their home.

The KAT had directed the HSE Department to cap the limit of reservation for Compassionate posting at 30 percent with 10 percent reservation for compassionate posting and 20 percent reservation for priority posting. But the published list came with blatant violations of these norms, alleges the teachers who are at the receiving end.

An HSS teacher who wished his name not to revealed said that this is a clear ploy by a section of teachers to scuttle the transfer process as they want to be in hometown. “We will stage huge protests against this” he added.

It looks like it is headed that way as it did a number of other issues in Kerala recently where strong protests had to be staged to ensure that justice is served.
