New law hands out first sentence; 19-year old faces death penalty for rape

Accused in rapes cases of those below the age of 12 are to be sentenced with the death penalty- this law was recently sanctioned by various states and the Bill was passed.

And the first-ever sentence under the law is to take place in a case where a 19-year-old had raped a baby.

19-year-old has been ordered to be hanged for raping a seven-month-old baby in Rajasthan this year. This is the first death sentence ordered by a court in Rajasthan after the tougher sexual abuse law was passed by the state assembly in March that allows the death penalty in the rape of minors under 12 years of age.

Rajasthan is the second state in the country to have brought such a law in force after Madhya Pradesh passed it in December.

The baby was with her grandmother who was blind when the accused, identified as Pintu, had taken the child away on the pretense of playing with her on May 9th.

 “After half an hour, we heard the kid crying at the football field and rushing there, found her bleeding profusely. Pintu had run away leaving her in a pathetic plight,” the father said in his police complaint on the same day.

The baby was then admitted in Alwar hospital for 20 days. The accused was arrested later and a medical examination confirmed rape.

The police had filed a case under the necessary sections of the Indian Penal Code and the Protection of Children from Sexual Offences (Pocso) Act and completed the investigation with 27 days and presented the matter before the court.

The case was fast-tracked and a verdict was reached after just 13 hearings. The court convicted the accused on Wednesday and announced the sentence on Saturday.

Such a case is the first in the state and 3rd in the country. In the first 2 cases, the accused were given the death sentence.
