A 24-year-old man was caught having sex with his 14-year-old cousin when her grandmother walked in on them, but he won’t be jailed.The man, who can’t be named for legal reasons, stayed over at the house the girl lived in in Tasmania in 2017 after having drinks, The Mercury reported.
One night he stayed in the girl’s bed and the next morning her grandmother walked into her room to collect laundry, only to find them having sex.The grandmother told the pair that what they were doing was wrong because they are related, but the girl replied that they were in love.
‘I am told the defendant did not consider he was acting unlawfully on the basis that the sexual contact was consensual,’ Justice Stephen Estcourt told the court during the sentencing.The man, who has a mental disability, was handed a suspended six-month jail sentence.
