SC Seeks Centre’s Response to Tamil Nadu Government’s Claim of Governor’s Delay in Bill Approval

On Friday, the Supreme Court directed the Centre to respond to Tamil Nadu’s claim of gubernatorial delay in approving bills passed by the state Assembly. Chief Justice D Y Chandrachud and Justices J B Pardiwala and Manoj Misra issued a notice, scheduling further proceedings for November 20 and seeking the involvement of the Attorney General or Solicitor General.

Representing Tamil Nadu, senior advocate Abhishek Singhvi highlighted that Governor R N Ravi had not yet given assent to 12 bills passed by the Assembly. The state government, alleging “unconstitutional” hindrance by a “constitutional authority,” urged the Supreme Court to intervene.

The plea sought a declaration that the Governor’s inaction and delay in considering bills and other matters forwarded by the State Legislature were unconstitutional, illegal, arbitrary, and malicious. It emphasized the detrimental impact on the state administration, accusing the Governor of disrupting the system by not approving remission orders, daily files, appointments, and more. The plea contended that this obstruction extended to critical issues like approving CBI investigations into corruption cases involving ministers and MLAs, as directed by the Supreme Court.

The Tamil Nadu government implored the Supreme Court to address the situation, asserting that the Governor’s actions were not only unconstitutional but also creating a hostile environment by impeding essential administrative functions.
