Supreme Court to consider petition over delay in judges’ appointment

On Monday, the Supreme Court is set to hear two petitions, one of which alleges a delay by the Centre in approving names recommended by the collegium for judges’ appointment and transfer. A bench comprising Justices Sanjay Kishan Kaul, Sudhanshu Dhulia, and Sandeep Mehta had previously scheduled the hearing for Monday. The two pleas address the delay by the Centre and the “wilful disobedience” of the time-frame established by the apex court in its April 20, 2021 order to ensure timely judicial appointments.

During the last hearing on November 7, the Supreme Court voiced concerns about the “selective pick and choose” approach in appointing judges recommended by the collegium for higher judiciary positions. The court also expressed apprehensions about the backlog of names proposed for transfer between high courts. The bench emphasized to the attorney general that the pendency of transfer matters is a significant concern and urged that the government should not be troubled by the locations where judges, once appointed, carry out their judicial duties. The court hopes to avoid a situation where decisions need to be made by the court or collegium that would be disagreeable.
