A petition urging a reconsideration of the October 17 verdict, which declined legal recognition for same-sex marriages, was mentioned before the Supreme Court on Thursday, seeking an open court hearing. Senior advocate Mukul Rohatgi, representing one of the petitioners, informed the bench led by Chief Justice D Y Chandrachud that an open court hearing was essential to address the concerns of those advocating for the validation of same-sex marriages. The bench, including Justices J B Pardiwala and Manoj Misra, acknowledged the submission and expressed the need to circulate the review plea among judges of the constitution bench.
The Chief Justice stated that he had not yet examined the review petition and proposed circulating it among the judges. All judges on the constitution bench agreed that there was some form of discrimination against queer individuals, emphasizing the need for relief. The review plea is scheduled for consideration on November 28, as per the apex court registry.
In early November, one of the petitioners sought a review of the October 17 judgment, wherein the constitution bench, headed by the Chief Justice, delivered four separate verdicts on 21 petitions seeking legal approval for gay marriages. While all five judges unanimously rejected legal backing for same-sex marriages under the Special Marriage Act, a 3:2 majority held that queer couples do not possess the right to adoption.
