The Allahabad High Court has dismissed five suits challenging the maintainability of a civil suit in Varanasi seeking the restoration of a temple at the site of the Gyanvapi mosque. Justice Rohit Ranjan Agarwal declared that the 1991 suit filed in Varanasi is maintainable and not barred by the Places of Religious Worship Act, 1991. The court further ordered a comprehensive survey of the Gyanvapi mosque site. The petitions were filed by the Anjuman Intezamia Masjid Committee (AIMC) and the Uttar Pradesh Sunni Central Waqf Board, contesting the Varanasi court’s order from April 8, 2021, for a survey of the Gyanvapi mosque. The AIMC, responsible for the Gyanvapi mosque near the Kashi Vishwanath temple, challenged the suit filed in Varanasi, where Hindu petitioners seek the restoration of a temple at the mosque’s present site, claiming the Gyanvapi mosque is part of the temple. The Anjuman Intezamia Masajid Committee and UP Sunni Central Waqf Board argued that the suit is prohibited by the 1991 Places of Worship Act, which restricts altering the character of religious places as it existed on August 15, 1947.
