In response to the rising concerns surrounding AI-generated deepfake videos, the Indian government has issued an advisory to all social media platforms, instructing them to ensure compliance with existing IT rules. The advisory specifically directs intermediaries to clearly and precisely communicate prohibited content, particularly those specified under Rule 3(1)(b) of the IT Rules, to users. It mandates explicit communication of such content to users at the time of first registration and as regular reminders during login and information sharing on the platform. The advisory also emphasizes the obligation of intermediaries to inform users about penal provisions, including those in the IPC and the IT Act 2000, in case of IT rule violations.
The government’s advisory further requires intermediaries to clearly highlight in terms of service and user agreements that they are obligated to report legal violations to law enforcement agencies under relevant Indian laws. It aims to ensure that platforms promptly identify and remove misinformation, false or misleading content, and material impersonating others, including deepfakes. The advisory follows discussions between IT Minister Rajeev Chandrasekhar and digital intermediaries during the Digital India dialogues, where the minister stressed the importance of adhering to current laws and regulations, particularly addressing the menace of deepfakes.
