A triple talaq is a form of Islamic divorce which has been used by Muslims in India.It allows any Muslim man to legally divorce his wife by stating the word ‘talaq’ three times in oral, written and more.
It has been a subject of controversy and debate. It questions the justice, gender equality, human rights and secularism. Triple talaq as a practice is not mentioned in the Quran or Sharia law. It is also largely disapproved by Muslim legal scholars. Several Islamic countries, including Pakistan and Bangladesh, have banned it.
Triple talaq, in Islamic law, is based upon the belief that the husband has the right to reject or dismiss his wife. If the wife wants to end her marriage and her husband does not agree to give a talaq, she has to go through proceedings under the Dissolution of the Muslim Marriages Act. These turns more controversies among the people. Triple talaq has been supported by the All India Muslim Personal Law Board (AIMPLB) but at the same time there exist a lot of opposition from Muslim women and Muslim legal scholars.
Here comes an end to these controversies. The Supreme Court on blocked the use of a controversial Muslim divorce law until the government frames new legislation, a partial victory for Muslim women who had long argued that the law violated their right to equality. Three out of the five judges on the constitution bench ruled against the “triple talaq”, which allowed Muslim men to divorce their wives simply by stating the word “talaq” three times.
“This is a sensitive case where sentiments are involved. We are directing the Union of India to consider appropriate legislation in this regard,” Justice JS Khehar said while announcing a six-month suspension on the practice of the divorce law.
“It’s a very happy day for us. It’s a historic day,” said Zakia Soman the co-founder of the Indian Muslim Women’s Movement.
Bharatiya Muslim Mahila Andolan, a Muslim organization, launched a campaign two years ago to ban triple talaq.
Congress vice-president Rahul Gandhi welcomed the apex court verdict.“A victory of our constitutional values. Will repeat what PM has said earlier, don’t link it to any religion,” BJP leader and law minister Ravi Shankar Prasad said after the court decision.
But there exist statements against BJP that this issue is being exaggerated by BJP led government to tarnish the Muslim community as a whole. The point to remember is that the person who went to the supreme court seeking a ban on triple talaq was a Muslim woman from Chennai, Then how come BJP?. However, this is a win for BJP as said earlier they are the one who helped women and little girls who got married and facing these type of discrimination in the name of talaq laws.
Whatever this will be a happy news for all Muslim women. Now, men will be a bit scared to say ‘talaq’
